Commercial Advertising on www.rapidmove.com

9. The terms and conditions outlined in this broadcast apply to commercial and community type advertisements which are charged at the rates as per our pricing policy. All advertisements are charged in advance of publication and accounts must be settled prior to the content being published. Rapidmove UK Ltd reserve the right to remove any adverts without notice where accounts are not settled for content that is online.

10. Rapidmove UK Ltd reserve the right to refuse any advertisement that is deemed to cause offence to any party by our editorial and management personnel.

11. Advertisements that are offered on a promotional basis which do not incur any charges maybe replaced with paid advertisements at anytime without notification.


Additional Contributions to www.rapidmove.com

12. Where you are invited to submit any contribution to www.rapidmove.com (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant the Rapidmove UK Ltd a perpetual, royalty-free, non-exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in the website Privacy Statement. If you do not want to grant to the Rapidmove UK Ltd the rights set out above, please do not submit your contribution to www.rapidmove.com.

13. Further to paragraph 9, by submitting your contribution to www.rapidmove.com, you:

10.1 warrant that your contribution;

10.1.1 is your own original work and that you have the right to make it available to the Rapidmove UK Ltd for all the purposes specified above;

10.1.2 is not defamatory; and

10.1.3 does not infringe any law; and

10.2 indemnify the Rapidmove UK Ltd against all legal fees, damages and other expenses that may be incurred by the Rapidmove UK Ltd as a result of your breach of the above warranty; and

10.3 waive any moral rights in your contribution for the purposes of its submission to and publication on www.rapidmove.com and the purposes specified above.


Force Majeure

11. Neither party shall be liable to the other, for any loss or damage which may be suffered by the other party due to any cause beyond the first party's reasonable control including without limitation any power failure.


General

12. If there is any conflict between these terms and specific terms appearing elsewhere on www.rapidmove.com then the latter shall prevail.

13. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

14. These terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Terms and Conditions applicable to Deferred Payment Options

Rapidmove (UK) Limited (the Company) agree to provide in certain circumstances which are purely at the discretion of the Company Deferred Payment Terms to customers. Such terms will be on the basis of a six month agreement whereby credit will be provided to the customer against the costs involved in the preparation and order of parts of their Home Information Pack (HIP)

Customers should be aware that the completion and signature of a Deferred Payment Authority is a legal document and is binding on them. Customers are advised to seek independent legal advice if they are unsure about any of the terms. The cost of the Deferred Option Pack includes interest to cover the outstanding cost balance borne by the Company and will be required to be paid out of the proceeds of sale of the property within 48 hours of completion.

The Deferred Payment Authority is the customer's irrevocable instructions to their legal representatives to make payment and if for any reason their legal representatives fail to comply with the payment terms the customer will remain fully liable for the debt to the Company.

If the property is withdrawn from sale with the initial instructing agent the Company may withdraw the terms of the Deferred Payment Authority again at their absolute discretion. For consent to transfer the deferred option to an alternative firm of agents or solicitors notice should be provided to the Company within 7 days and approval will be provided by a Director of the Company by post or e-mail as soon as is reasonably practicable.
